Apple has recently had some success with its cases against the Samsung Galaxy tab 10.1 in other places across the world, but it seems their luck drew short in Germany where there most recent claim that Motorola’s Xoom tablet infringes upon Apple’s design registration on the iPad.
This decision is not that surprising as Apple has already had some issues with the Galaxy Tab 10.1 design also in Germany, alongside this German law states that both sides must be considered in order to win or lose something, which they agreed there are some noticeable differences between the two and there is not enough to say that Motorola had copied Apples design.
Because of this the court split the legal costs, requiring Apple to pay two-thirds and Motorola the remaining.
