Recently Oracle have been in a case against the German company usedSoft because of their buying and reselling of software licenses, the case is now offer which was decided in favor of usedSoft.

The German Federal Court of Justice has now said that all EU citizen’s will be protected, the order states that a software author’s exclusive licence to distribute a given copy of its product is exhausted with its initial distribution, allowing the owner of said licence to distribute however they please.

This ruling will apply to both future and pre-existing end-user agreements, which means even if the licence agreement prohibits further transfer, the rightholder cannot oppose the re-sale of said copy and will apply with both physical and digital purchases made in the EU.
